1. Introduction
Welcome to Prismas. These Terms and Conditions (“Terms”) govern your access to and use of our WhatsApp marketing automation platform (“Service”).
By registering, accessing, or using our Service, you agree to comply with these Terms and all applicable laws and platform policies.
2. Compliance with WhatsApp & Meta Policies
Users of Prismas must strictly comply with:
- WhatsApp Business Messaging Policy
- WhatsApp Business Commerce Policy
- Meta Platform Terms
Violation of these policies may result in:
- Immediate suspension of messaging privileges
- Permanent disabling of WhatsApp Business accounts
- Termination of access to Prismas
Prismas reserves the right to suspend or terminate accounts that violate Meta policies.
3. Opt-In Requirement (User Responsibility)
You agree that:
- You will obtain explicit and verifiable opt-in consent from recipients before sending marketing or promotional messages.
- You will maintain records of such consent.
- You will provide opt-out mechanisms in all marketing communications.
Prismas is not responsible for penalties arising from failure to obtain valid opt-ins.
4. Prohibited Content & High-Risk Categories
The use of Prismas is strictly prohibited for:
- Adult content or sexually explicit material
- Illegal drugs, narcotics, or controlled substances
- Gambling, betting, or casino services (unless legally licensed and permitted by Meta)
- Weapons or explosive materials
- Financial scams or misleading offers
- Cryptocurrency fraud or unlicensed investment schemes
- Hate speech, harassment, or abusive content
Accounts involved in prohibited activity will be immediately terminated.
5. Quality Rating & Enforcement Transparency
Users acknowledge:
- WhatsApp monitors phone number Quality Rating (Green, Yellow, Red).
- Customer reports (Spam/Offensive) impact quality rating.
A low rating may result in:
- Messaging limits
- Temporary blocks
- Permanent suspension
Prismas does not control Meta’s enforcement decisions.
6. API Credentials & Access
Depending on platform configuration:
- Users may connect their own WhatsApp Business API credentials, OR
- Use Prismas-managed infrastructure under shared compliance terms.
Users are responsible for securing their API tokens and access keys.
7. Suspension & Termination
Prismas reserves the right to:
- Suspend accounts violating these Terms
- Remove access to messaging features
- Terminate services without refund in case of serious violations
8. Limitation of Liability
Prismas shall not be liable for:
- Account bans by Meta
- Message delivery failures due to platform restrictions
- Revenue losses caused by policy violations
- Media upload failures or HMAC validation issues arising from third-party platform restrictions
9. Modifications
Prismas may update these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.
